Terms of Use

1. Agreement and Eligibility

These Terms of Use (“Terms”) govern your access to and use of the Luonio mobile application (the “App”) and its related features, cloud functionality, support, and services (collectively, the “Services”). The Services are provided by Airat Bakhteev, an independent developer based in Türkiye (“Luonio,” “Developer,” “we,” “us,” or “our”).

By downloading, accessing, purchasing through, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms form an agreement between you and the Developer, not Apple.

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Services are not intended to bypass any higher minimum age or parental-consent requirement imposed by applicable law.

2. About Luonio

Luonio analyzes food labels, ingredient lists, nutritional information, and related product information using image processing, optical character recognition (“OCR”), and other automated analysis technologies. It may provide scores, explanations, and checks against goals selected or entered by the user. Luonio is an informational tool; it does not independently verify product composition, manufacturing practices, allergen controls, or the accuracy of packaging.

3. Relationship to Apple’s Standard EULA

The App is distributed through the Apple App Store and is also subject to Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”) and applicable App Store usage rules. These Terms supplement the Apple Standard EULA and describe Luonio-specific features, subscriptions, usage allowances, and responsibilities. If these Terms conflict with mandatory Apple terms, the mandatory Apple terms control to the extent of the conflict.

Apple is not a party to these Terms and is not responsible for the Services, support, maintenance, product claims, or Luonio-specific content, except to the extent required by the Apple Standard EULA or applicable law. Apple and its subsidiaries are intended third-party beneficiaries of the provisions that relate to the licensed App and may enforce those provisions as permitted by Apple’s terms.

4. License to Use the App

Subject to these Terms, the Apple Standard EULA, and applicable App Store usage rules, the Developer grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the App on Apple-branded devices that you own or control for personal, non-commercial purposes.

The App is licensed, not sold. No ownership interest in the App, Services, software, designs, databases, analysis systems, branding, or other materials is transferred to you.

5. Free Scans

Luonio currently provides eligible users with five free food-label scans for the lifetime of their eligibility for the free allowance. The allowance is introductory access, not a recurring daily, monthly, device-based, installation-based, or account-deletion benefit.

Deleting an account, reinstalling the App, resetting App data, changing devices, or creating or receiving a new anonymous account does not restore or create an additional free allowance. We may use limited account, device, usage, transaction, and technical signals to enforce eligibility and prevent circumvention, fraud, or abuse, as described in the Privacy Policy.

We may change the number, availability, scope, or conditions of free scans for prospective use, subject to applicable law. The App interface will display the currently applicable allowance. We will not charge you merely for exhausting free scans; a purchase requires your confirmation through Apple’s purchase flow.

6. Luonio PRO Subscriptions

Luonio offers auto-renewable Monthly PRO and Yearly PRO subscriptions through Apple In-App Purchase. No free subscription trial is currently offered. The exact price, currency, billing period, taxes, and any storefront-specific terms are displayed by Apple and in the App before purchase. Information shown in Apple’s purchase confirmation controls if it differs from general descriptions in these Terms.

An active PRO subscription currently provides:

an allowance of up to 50 food-label scans per calendar day;

access to the “Explain Product” feature without a separate stated numerical allowance; and

access to the “Check Product Against My Goals” feature without a separate stated numerical allowance.

PRO features remain subject to these Terms, service availability, fair use, security protections, technical capacity, and any limits clearly disclosed before use or purchase.

7. Daily Scan Allowance and PRO Features

7.1 Calendar-Day Allowance

The 50-scan PRO allowance is measured by calendar day according to the timekeeping and reset method used by the Services. The reset time may be based on server time, account configuration, device region, or another consistently applied technical method shown or reflected in the App. Because time zones, connectivity, delayed requests, and system maintenance can affect timing, the reset may not occur exactly at local midnight on every device.

Unused daily scans do not roll over, accumulate, convert to cash, transfer between users, or create a credit. A scan may count when processing begins or when server resources are committed, including if the result cannot be completed because of an unreadable label, poor image quality, unsupported content, connectivity interruption after submission, or another circumstance outside our reasonable control. We may restore an allowance where appropriate, but are not required to do so unless applicable law requires it.

7.2 Features Without a Separate Numerical Allowance

“Explain Product” and “Check Product Against My Goals” do not currently have a separate user-facing numerical allowance for active PRO subscribers. “Unlimited” means that no ordinary fixed usage count is advertised for these features; it does not mean unlimited computing capacity or a right to automated, abusive, commercial-scale, or technically disruptive use.

We may apply reasonable rate limits, temporary throttling, queueing, or safeguards to protect security, availability, costs, other users, and the integrity of the Services. Such measures will not be used to deprive ordinary users of the core ongoing value of an active subscription.

7.3 Subscription Verification

PRO access depends on successful verification of an active Apple subscription and may be managed through Apple and RevenueCat. Temporary verification or connectivity problems can delay access or restoration. You should use the App’s restore-purchases function where available and contact support if access remains unavailable.

8. Payments, Renewal, Cancellation, and Refunds

Payment is charged to your Apple Account when you confirm the purchase. A subscription automatically renews for the same billing period unless you cancel it through your Apple Account at least 24 hours before the end of the current period, subject to Apple’s then-current rules. Apple may charge the renewal price within 24 hours before the current period ends.

You can manage or cancel a subscription in your Apple Account subscription settings. Deleting the App or your anonymous Luonio account does not cancel a subscription. After cancellation, PRO access generally continues until the end of the paid billing period unless Apple provides otherwise. We cannot cancel an Apple subscription on your behalf.

Apple processes payments and refund requests. Refund eligibility and price changes are governed by Apple’s applicable policies, storefront terms, and mandatory consumer law. Contact Apple to request a refund. Nothing in these Terms limits any non-waivable refund, withdrawal, conformity, or consumer right available under the law that applies to you.

Apple may change subscription prices in accordance with its rules and applicable law. Where consent or notice is required, Apple or Luonio will provide it through an appropriate channel. If you do not accept a change that requires acceptance, you may cancel before renewal.

9. User Content and On-Device Storage

The App may let you save personal notes, custom product names, selected product photographs, preferences, favorites, and similar content (“User Content”). Based on the current design, these personal notes and saved product photographs are stored locally on your device and are intended to be accessible only to you through that device. They are not uploaded to Luonio servers merely because you save them locally.

You retain your rights in User Content. You grant Luonio only the limited permission necessary to process content that you intentionally submit to the Services—for example, a label image submitted for analysis or material submitted in an error report. This permission is worldwide, non-exclusive, royalty-free, and limited to operating, securing, supporting, and improving the requested Services. It ends when the content is deleted from our systems, subject to reasonable backup, security, legal, and error-report retention.

You are responsible for backing up local User Content. Uninstalling the App, deleting App data, changing devices, device failure, or operating-system actions may permanently delete it. Luonio does not guarantee recovery or synchronization of content stored only on your device.

You must have the right to submit any image or other content and must not include unnecessary personal, confidential, unlawful, or third-party information.

10. Acceptable Use

You may use the Services only lawfully, personally, and in accordance with these Terms. You must not:

circumvent or attempt to reset free-scan, daily, subscription, eligibility, rate, or technical limits;

create or cycle accounts, installations, devices, transactions, or identifiers to obtain repeated introductory benefits;

use bots, scripts, automation, scraping, bulk processing, or commercial-scale access without written permission;

reverse engineer, decompile, disassemble, discover source code, copy, modify, or create derivative works except where applicable law expressly permits it;

probe, disrupt, overload, damage, or gain unauthorized access to the Services, accounts, networks, or security controls;

submit malware, unlawful material, unrelated personal data, or content that infringes another person’s rights;

resell, sublicense, rent, redistribute, or make the Services available to third parties;

use results to provide medical diagnosis, allergy certification, regulated professional advice, or another high-risk service; or

use the Services in violation of applicable sanctions, export-control rules, or other laws.

11. Automated Analysis and Food Information

Results are produced automatically from images and available information. OCR and automated analysis can misread, omit, infer, mistranslate, simplify, or misunderstand content. Results may also become outdated because recipes, suppliers, packaging, production batches, regulations, and country-specific formulations change.

You must review the original, current product packaging and, when appropriate, contact the manufacturer. Do not rely on Luonio as the sole method of determining ingredients, allergens, nutritional values, suitability, legality, safety, or compatibility with personal goals. Scores, explanations, and goal checks express automated informational assessments, not objective certifications or guarantees.

12. No Medical or Allergy Advice

Luonio is not a medical device and does not provide medical, nutritional, pharmaceutical, diagnostic, treatment, emergency, or allergy-verification services. It does not establish that a product is safe, allergen-free, suitable for pregnancy, compatible with a condition or medication, or appropriate for a particular person.

If you have an allergy, intolerance, medical condition, dietary restriction, pregnancy-related concern, or other health concern, consult an appropriately qualified healthcare professional and verify information directly from current packaging and the manufacturer. In an emergency, contact local emergency services.

13. Service Availability and Changes

We aim to maintain reliable Services but do not guarantee uninterrupted, timely, secure, or error-free availability. Features may be unavailable because of maintenance, connectivity, demand, provider outages, platform changes, security events, force majeure, or technical limitations.

We may update, improve, replace, suspend, or discontinue features and may introduce reasonable technical or fair-use limits. For active paid subscriptions, we will not intentionally remove the core ongoing value without appropriate notice, remedy, or other treatment required by Apple’s rules or applicable consumer law.

14. Third-Party Services

The Services depend on third parties, including Apple, Google Firebase and Google Cloud, and RevenueCat. Third-party services have their own terms, privacy notices, availability, and technical requirements. We are not responsible for third-party acts or failures beyond our control, but this does not exclude responsibility that cannot lawfully be excluded.

Links to external websites are provided for convenience. Luonio does not endorse or control all external content, and you access it subject to its provider’s terms.

15. Intellectual Property

The App, Services, software, analysis methods, interface, text, graphics, branding, databases, compilations, and other materials—excluding your User Content and third-party materials—are owned by or licensed to the Developer and protected by intellectual-property laws. “Luonio” and associated branding may not be used without permission.

These Terms do not grant any right to use our trademarks, source code, proprietary datasets, models, prompts, system instructions, or confidential technology.

16. Feedback and Error Reports

If you submit feedback, suggestions, or ideas, you grant the Developer a perpetual, worldwide, non-exclusive, royalty-free right to use and incorporate them without compensation or attribution, provided this does not transfer ownership of your unrelated User Content. Error reports may include the relevant scan image, results, optional comments, and technical information, as explained in the Privacy Policy.

17. Privacy

Our Privacy Policy explains how information is collected, used, retained, disclosed, and protected, including fraud-prevention information and account deletion. The Privacy Policy is incorporated by reference for informational consistency but remains a privacy notice rather than a waiver of statutory rights.

18. Suspension and Termination

You may stop using the Services at any time and may delete your anonymous account through the App. Account deletion does not cancel a subscription.

We may restrict, suspend, or terminate access where reasonably necessary because of a material or repeated breach of these Terms, fraud, abuse, circumvention, security risk, legal requirement, provider restriction, or threat to the Services or other users. Where appropriate and legally required, we will provide notice and a reasonable opportunity to remedy the issue.

Termination ends your license and access rights but does not affect provisions that by their nature should survive, including intellectual property, accrued payment obligations, disclaimers, liability limitations, dispute provisions, and lawful retention. Termination does not automatically entitle you to a refund, except where Apple policy or applicable law requires one.

19. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE DEVELOPER DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, QUIET ENJOYMENT, AND AVAILABILITY. WE DO NOT WARRANT THAT RESULTS ARE COMPLETE, CURRENT, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR PURPOSE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY, REMEDY, OR CONSUMER RIGHT THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED. In particular, consumers may have mandatory rights under the laws of their country of residence.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON AUTOMATED RESULTS, PRODUCT CHANGES, USER CONTENT LOSS, THIRD-PARTY SERVICES, OR SERVICE INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER’S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR LUONIO PRO DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 50 OR ITS LOCAL-CURRENCY EQUIVALENT.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability for intent, gross negligence, death or personal injury where applicable, or mandatory consumer remedies. Some jurisdictions do not permit certain exclusions, so portions of this section may not apply to you.

21. Indemnification

To the extent permitted by applicable law, if you use the Services for commercial purposes or materially violate these Terms, you agree to indemnify the Developer against reasonable third-party claims, losses, and expenses arising directly from your unlawful use, infringement of third-party rights, or intentional circumvention or abuse. This section does not apply to ordinary consumer use where prohibited by law and does not require you to indemnify the Developer for the Developer’s own fault.

22. Governing Law and Disputes

These Terms and the relationship between you and the Developer are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except that mandatory consumer protections of your country of habitual residence remain applicable where they cannot be waived.

Before filing a claim, please contact support@luonio.com and provide a brief description of the issue. We will attempt in good faith to resolve it informally. This does not prevent you from seeking urgent relief or using a consumer authority, consumer arbitration committee, consumer court, regulator, or other forum available under mandatory law.

Subject to non-waivable consumer jurisdiction rules, disputes may be submitted to the competent courts and consumer authorities of Türkiye. These Terms do not require individual arbitration and do not waive participation in a class or collective procedure where such a waiver would be invalid under applicable law.

23. Changes to These Terms

We may update these Terms to reflect changes to the Services, subscriptions, law, providers, security, or operations. We will update the effective or last-updated date. If a change materially affects an active paid subscription, we will provide notice or obtain consent where required. Changes apply prospectively from the stated effective date; continued use after that date constitutes acceptance only to the extent permitted by applicable law.

24. General Provisions

If a provision is invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a lawful transfer of the App or its operations, subject to applicable consumer law.

These Terms, the Privacy Policy, the Apple Standard EULA, and purchase terms displayed by Apple constitute the relevant agreement concerning your use of Luonio. If a translation conflicts with the English version, the English version controls where permitted by law. Statutory rights under a mandatory local-language version or local law remain unaffected.
